Arkansas Workers' Comp Insurance
Here we cover the specific state laws and requirements for small business employers and their Arkansas Workers’ Comp Insurance obligations.
First, who needs to be covered by Workers’ Comp coverage? Second, where can you get it? Also, how much does it cost? All of this is covered by state law.
Additionally, are you headquartered or based in Arkansas, but have employees working, or transiting on the clock, to or through another state to perform work? Further, the Workers’ Compensation laws in THAT or THOSE states will also determine coverage requirements. Finally, if your employees are working in more than one state, you will need coverage in each state.
WorkersComp4SmallBusiness can help with just that.
Importantly, in the state of Arkansas, small business employers with three or more (3+) employees are required by state law to have Workers’ Compensation insurance coverage for their employees or file and be approved to self-insure.
Obviously, while there are exceptions to the three plus (3+) employee requirement, any employers with fewer than three employees should check with state authorities before making any assumptions about Arkansas’ Workers’ Comp regulations. Consequently, Small Business employers that might have doubts may request information from the Arkansas Commission’s Information Officer or Operations/Compliance Division, or the Arkansas Commission Legal Advisor Division.
Of course, Workers’ Compensation Insurance is purchased by the Small Business Employer – it is NOT paid for by employees or CANNOT be deducted from the employees’ payroll.
Finally, benefits are provided through a Workers’ Compensation insurance policy, or in very rare cases by the employer’s state approved self-insured arrangement. In essence, any other arrangement by the small business employer or their representative may constitute fraud.
Why Carry Workers Compensation Insurance in Arkansas?
First of all, Small Businesses that fail to comply with these regulations may be subject to penalties by the state of Arkansas. Additionally, those employers may lose protections afforded them by Arkansas’ Workers’ Compensation laws and Workers Compensation Insurance.
Accordingly, Small Businesses whose Workers’ Compensation insurance coverage cannot be verified by the Arkansas Workers’ Compensation Commission will be contacted by letter, questionnaire or by a personal visit.
Additional Workers' Comp Requirements in Arkansas
Also, Small business employers with current workers’ comp coverage must have a poster of instructions displayed at the worksite. Small businesses who fail to display these may lose some of the protection provided them.
Additionally, employers or their insurance representatives have the right to choose doctor(s) to treat injured workers but notice of these choices must be given to employees. Likewise, if the employer’s representative has a managed care organization (MCO) for work-related injuries, a health notice (Form H) must be posted at the business. MCO regulations are found in Rule 099.33.
